SYNOPSIS OF LEGISLATION

ANZ EXECUTORS & TRUSTEE COMPANY (SOUTH AUSTRALIA) LIMITED (TRANSFER OF BUSINESS) BILL

 

This Bill has been requested by ANZ Trustees to enable it to rationalise its operation in South Australia. Two ANZ companies are trustee companies under the South Australian Trustee Companies Act 1988. These companies are ANZ Executors and Trustee Company Limited, referred to as ANZ Trustees, and ANZ Executors and Trustee Company (South Australia) Limited.

 

ANZ Trustees wishes to amalgamate the operation of both companies under the umbrella of ANZ Trustees, and the most efficient method of achieving this is by an Act of Parliament to transfer the trusts, agencies, assets and liabilities of ANZ Executors and Trustee Company (South Australia) Limited to ANZ Trustees.

ASSOCIATION INCORPORATION (MISCELLANEOUS) AMENDMENT BILL

 

The purpose of this Bill is to amend the Associations Incorporation Act 1985 in relation to the procedures for winding up of associations and a provision that will enable incorporated associations to enter voluntary administration with a view to executing a deed of arrangement with creditors. Voluntary administration is a form of external administration which was made available to companies approximately three years ago but which has not previously been an option for associations experiencing financial difficulties.

CHILDREN’S SERVICES (CHILD CARE) AMENDMENT BILL

 

The purpose of this Bill is to -

 








allow a family day care careprovider to have up to seven children in care at any one time (including those of the careprovider), provided that not more than four have not yet commenced their first year of schooling;
permit one additional child to be in care under exceptional circumstances;
provide transitional arrangements to prevent any existing careprovider being disadvantaged in relation to children now in the person’s care;
amend the definition of a "child care centre" to be compatible with the above;
extend the licensed period of operation for a child care centre from 12 months to two years.

The purpose of this Bill is to provide a consistent legislative framework for the formation, registration and corporate governance of co-operatives. The Bill is based on Victorian legislation which was developed through the co-operation of the States and Territories.

A significant increase in the role and powers of the Administrator in relation to forfeited or restrained property;
Explicit application of the powers in the Bill to financial institutions;
Statutory recognition of the essential difference for sentencing and forfeiture purposes between the profits of criminal activity, on the one hand, and property which is tainted because it was, for example, used in the course of the commission of the offence, on the other hand;
Making it clear that a court may make an order for the forfeiture of a pecuniary sum which represents a part of the value of a tainted asset;
Extension of the forfeiture provisions to the summary offences of being in possession of personal property reasonably suspected of having been stolen or obtained by other unlawful means and the offences of producing, selling, exhibiting and dealing with indecent or offensive material, including child pornography;
Extension of the powers of South Australian courts to deal with tainted property, wherever it may be, to the limits of the power of the Parliament to legislate extra-territorially;
The enactment of a scheme designed to limit access to restrained funds and assets in order to pay legal fees to cases in which there are no other assets or funds available to provide for defence representation; and
Enactment of a scheme of "administrative forfeiture".

CRIMINAL LAW CONSOLIDATION (SELF DEFENCE) AMENDMENT BILL

 

The objective of this Bill is to identify the complexities of the law relating to self defence and remove or simplify them without creating prejudice to generally law-abiding citizens who, in unforeseen circumstances, may have to use force to defend themselves and their property.

 

The major substantive change from current law in section 15 is that, for an acquittal, the force used by the person in self-defence must be objectively reasonable on the facts as he or she believed them to be, rather than, as section 15 currently states, it suffices if the person genuinely believes that the force used was reasonable in all of the circumstances.

The purpose of this Bill is to allow suitably qualified clinical dental technicians to supply partial dentures directly to the public.

DEVELOPMENT (TELECOMMUNICATIONS) AMENDMENT BILL

 

The purpose of this Bill is to declare telecommunications towers and cabling as development under the Development Act and therefore subject to development plans.

ECOLOGICALLY SUSTAINABLE ENERGY BILL

 

This Bill seeks to establish an Ecologically Sustainable Energy Authority to assist the South Australian community with the transition to an ecologically sustainable energy industry and to bring about greater efficiency in the uses of energy. The authority would have four objectives - first, to minimise the use of non-renewable energy sources; secondly, to optimise the use of ecologically sustainable energy sources; thirdly, to minimise greenhouse gas emissions and pollutant wastes associated with energy production; and, fourthly, to minimise energy use. To achieve these objectives the authority would assist in the development of relevant State and local government laws, policies and practices, research or promote research into energy sources available in the State and energy efficiency, and consult with and make recommendations to electricity corporations and the State Government on all such relevant matters.

EDUCATION (COMPULSORY SCHOOL AGE) AMENDMENT BILL

 

The purpose of this Bill is to ensure that children will be required to be enrolled at school and attend school up until they turn sixteen years, unless as fifteen year olds they have organised an apprenticeship, enrolled for full-time study at TAFE or they have been able to secure full-time employment.

ELECTORAL (COMPUTER VOTE COUNTING) AMENDMENT BILL

 

The purpose of this Bill is to allow a computer to be used in the scrutiny of votes in Legislative Council elections.

 

The Bill provides that the Electoral Commissioner may approve a computer program to carry out steps involved in the scrutiny of votes in a Legislative Council election. The Commissioner can only approve a computer program after providing a demonstration to representatives of the registered political parties and if the proper use of the program would produce the same result in the scrutiny of the votes as would be obtained in the scrutiny conducted without a computer. This Bill is based on recommendations made by the Electoral Commissioner after the December 1993 Parliamentary Elections concerning the improvement of election administrative arrangements during the election period and the past election period.

 

The Bill also provides for the appointment of the Electoral Commissioner by the Governor on a recommendation made by Resolution of both Houses of Parliament. The task of inquiring into and reporting on a suitable person has been given to the new Statutory Officers Committee established under the Parliamentary Committees Act 1991.

FRIENDLY SOCIETIES (SOUTH AUSTRALIA) BILL

 

The purpose of this Bill is to adopt the Friendly Societies Code in South Australia which provides for the governance and regulation of friendly societies, and functions and powers of the State Supervisor. Provisions of the Code are similar to the Financial Institutions Code for building societies and credit unions. However, because of the issues unique to friendly societies (in particular, the need for special provisions relating to benefit funds and the responsibilities of actuaries of friendly societies) discrete legislation has been prepared rather than amend the Financial Institutions Code to integrate friendly societies.

GOODS SECURITIES (MOTOR VEHICLES) AMENDMENT BILL

 

The purpose of this Bill is to extend the services provided by the Vehicles Securities Register through participation in a national security interests checking system. It is intended that South Australia will enter into a service and compensation arrangements with vehicles securities registers in other States and Territories that have corresponding laws. This will provide South Australia with access to security interests recorded in Victoria, New South Wales, Queensland, the Northern Territory and the Australian Capital Territory.

The purpose of this Bill is to make minor amendments to the Juries Act 1927 to repeal outdated and cumbersome procedural provisions so that the Act or regulations made under the Act will reflect current practices of jury management.

LAND ACQUISITION (RIGHT OF REVIEW) AMENDMENT BILL

 

This Bill seeks to address a concern relating to a lack of a review mechanism for land owners in relation to a proposed land acquisition by Government and Local Government bodies.

 

The Bill provides that the person who requests a review of a decision must apply in writing to the Minister within seven days of being served with a notice indicating that a request pursuant to section 12 of the Act has been refused. On receipt of the application for a review, the Minister will conduct the review or appoint a suitable person to conduct the review on behalf of the Minister.

LEGAL PRACTITIONERS (MEMBERSHIP OF BOARD AND TRIBUNAL) AMENDMENT BILL

 

The purpose of this Bill is to change the qualifications of Members of the Legal Practitioners Conduct Board and the Legal Practitioners Disciplinary Tribunal.

 

The Bill provides that members should have practised as a legal practitioner for five years (including for this purpose any period that the person has served in judicial office) to be eligible for appointment to the tribunal.

 

The requirements imposed on members of the board and the tribunal have also been strengthened. The Bill provides that a member’s position becomes vacant if the member is disciplined under the Act, by the Supreme Court, or under an Act or law of another State or Territory of the Commonwealth for regulating the conduct of persons practising the profession of the law. This will mean that persons who receive an admonishment under the Act, and persons who avoid discipline under the Act or by the Supreme Court by voluntarily requesting that their name be taken off a court’s roll of barristers and solicitors will be disqualified from membership of the tribunal or the board.

LEGAL PRACTITIONERS (MISCELLANEOUS) AMENDMENT BILL

 

The purpose of this Bill is to enable the running of the professional indemnity scheme, established by the Law Society, to be independently administered by a company that is still accountable to the Law Society, yet does have a conflict of interest. The Bill also allows money from the guarantee fund to be used for educational and publishing programmes conducted for the benefit of legal practitioners or members of the public.

LIQUOR LICENSING BILL

 

This Bill seeks to rationalise the many differences between various licences, give more power to local communities as well as placing a much greater emphasis upon responsible service of alcohol and minimisation of harm as the foundation of liquor licensing law.

 

The major changes in the Bill include -

 
















encouraging responsible attitudes towards the promotion, sale, supply and consumption and use of liquor, to develop and implement principles directed towards that end and to minimise the harm associated with the consumption of liquor;
increased advertising requirements for the grant, removal or transfer of a licence;
increased rights of intervention in proceedings before the licensing authority;
a wider general right of objection to an application;
to reduce the cost and time involved in making application for a grant, removal or transfer of a liquor licence;
higher penalties for the offence of sale or supply of liquor to an intoxicated person and to a minor;
removal of anti-competitive provisions in the Liquor Licensing Act 1985;
wider trading conditions for the holders of a liquor licence;
the removal of the general facility licence;
the creation of a special circumstances licence;
Sunday trading for hotels; and
extended trading hours for sale and supply of liquor.

MEMBERS OF PARLIAMENT (REGISTER OF INTERESTS) (RETURNS) BILL

 

The purpose of this Bill is to make a number of amendments to the principal Act to improve the legislation. The Bill reduces from 50 per cent to a 15 per cent interest in investments that must be declared. The Bill requires that all assets contributed to a joint venture in which a Member of Parliament has an interest, including those contributed by other parties, be declared. The Bill makes a Member of Parliament who carries out or is a party to a scheme to defeat, evade, prevent or limit the operation of the Act guilty of an offence and subject to a $5,000 fine. The Bill also reduces the thresholds for disclosure of the debts by Members of Parliament from $7,500 to $5,000 and loans or deposits made by a Member of Parliament from $10,000 to $5,000.

MOTOR VEHICLES (DEMERIT POINTS) AMENDMENT BILL

 

The purpose of this Bill is to clarify the intentions of the existing provisions of the Motor Vehicles Act 1959 in relation to the disqualification of drivers who accumulate 12 or more demerit points within a three year period. The Points Demerit Scheme was established to contribute to road safety by applying a sanction against drivers who repeatedly offend. The Scheme provides that a driver is liable to disqualification from holding or obtaining a licence for three months if an aggregate of 12 or more demerit points is accumulated within a period of three years.

MOTOR VEHICLES (FARM IMPLEMENTS AND MACHINES) AMENDMENT BILL

 

The purpose of this Bill is to exempt walking speed self-propelled farm machines from the requirements to be registered and covered by compulsory third party insurance. The machines concerned include cherry pickers and hydraulic lift platforms. The owner of the machines however, must carry a public liability insurance policy of at least $5 million.

MOTOR VEHICLES (INSPECTION) AMENDMENT BILL

 

This Bill provides for the introduction of pre-registration identity inspections for new vehicles and the appointment of authorised agents from the private sector to carry out these inspections. The Bill also facilitates the transfer of vehicle identity inspections that seek to confirm a vehicle is not a stolen vehicle, from the South Australian police to the Department of Transport.

NETHERBY KINDERGARTEN (VARIATION OF WAITE TRUST) BILL

 

The purpose of this Bill is to vary the terms of the Peter Waite Trust so as to empower the University of Adelaide to grant a lease over a piece of land (delineated in the schedule) for a preschool and other related purposes. The lease may be granted to the Minister, the Netherby Kindergarten or to the Minister and the Kindergarten jointly. The fetters on the university’s general power under its Act to grant leases are waived.

 

The Bill also gives immunity to the university, the Kindergarten and all other relevant persons from liability for breach of trust arising out of anything done pursuant to this Act or the Kindergarten’s previous occupation of the land.

NON-METROPOLITAN RAILWAYS (TRANSFER) BILL

 

The purpose of this Bill is to provide the framework for the sale of Australian National (AN) and the transfer to the State of Commonwealth land. The Bill -

ratifies the Railways Agreement 1997, thereby permitting the sale of parts of AN which the State owned pre-1975;
authorises the Minister for Transport to enter into land leases to the new operator(s), which will contain the step-in provisions;
vests land in the Minister, and provides for certificates for identification of real or personal property;
severs track infrastructure so that it may be dealt with separately, allowing the Commonwealth to sell this;
provides a five year exemption from council rates and land taxes, as a concession to assist the new operator(s) to become established; and
provides a short exemption from liquor licensing to cover the time needed for processing of an application lodged by the interstate passenger operator in the various States.

PARTNERSHIP (LIMITED PARTNERSHIPS) AMENDMENT BILL

 

The purpose of this Bill is to recognise and regulate limited partnerships and to make other minor uncontroversial amendments to the Act.

 

A limited partnership as generally understood is an ordinary partnership with limited liability passive partners added on. The essence of a limited liability partnership is that the passive partners contribute equity to the firm but do not take part in management and are limited in regard to their liability to third parties to the extent of their subscribed capital.

 

The Bill provides statutory recognition of limited partnerships, and alters the general law of partnerships as far as necessary to accommodate limited partnerships. However, the Bill does not intend to completely regulate limited partnerships. Much of the detail should be left to the partnership agreements, and the general laws of partnership. More particularly, the Bill provides for the formation and composition of limited partnerships, when a partner is a limited partner, the rights and obligations of the limited partner and the requirements that must be complied with for limited partnerships not registered in South Australia to be recognised by South Australian law. Also it provides for the cessation and dissolution of limited partnerships, the obligations of limited partnerships and the requirements for changing partners or liabilities.

POLICE (COMPLAINTS AND DISCIPLINARY PROCEEDINGS) (MISCELLANEOUS) AMENDMENT BILL

 

This Bill makes a number of amendments to the Police (Complaints and Disciplinary Proceedings) Act over a wide area. The main matters dealt with are -

 






























Informal Complaint Resolution - a scheme for the resolution of minor complaints by informal means.
Power to Delegate - providing the Police Complaints Authority the power to delegate to a staff member of the Authority.
Complaints to which the Act applies - dealing with complaints by one police officer about the conduct of another.
Necessity for a Complaint - enabling the Authority to initiate an investigation without a complaint.
Disclosure by Witnesses - the Authority may direct witnesses not to disclose any information.
Information about the Complaint - giving the person against whom a complaint has been made particulars of the matter under investigation.
Offences - making it an offence for a civilian witness to furnish information or make a statement knowing that it is false or misleading.
Directions to Investigating Officer - the Authority to have the ability to direct police officers.
Administration of the Act - committing the administration of the Act to the Attorney-General clearly keeps the responsibility for policing and administration of the police separate and independent from complaints oversight.
Duplication of Registration of Complaints - the Authority to assume the sole responsibility for maintaining a register in respect of all complaints under the Act.
Reasons for Decision - the Police Disciplinary Tribunal is required to provide reasons for its decisions if requested by the Authority.
Secrecy - a provision is made for divulging information to a court where the interest of justice require it to be divulged.
Offences relating to Complaints - penalties for false representation are increased from $2,000 to $5,000 or imprisonment for one year.
Variation of Assessment - it is desirable that the Authority’s assessment can be varied if necessary in the light of additional information.
Statute Law Revision - expressing the Act in gender neutral language.

The Bill will provide suitable powers to ensure that rail operations can be undertaken efficiently and effectively, to ensure that rail corridors are afforded competitive neutrality with roads and to provide an access regime that addresses competition issues in the context of possible monopoly power in private hands.

RETAIL SHOP LEASES AMENDMENT BILL

 

This Bill responds to a number of the concerns identified by the Joint Parliamentary Select Committee on Retail Shop Leases. The amendments are designed to improve the operation and effectiveness of the Retail Shop Leases Act and to ensure that lessees have as much information as possible prior to making a decision as to whether or not to enter into a lease and are then to be able to make an informed decision, knowing the consequences if a lease is entered into.

 

A key feature of the Bill is a new Part 4A "Term of Lease and Renewal" which seeks to achieve an appropriate balance between the interests of lessors and lessees and to promote fair dealing.

The purpose of this Bill is to amend the Road Traffic Act 1961 so as to provide for the safe and efficient operation of the Southern Expressway.

 

The Bill inserts a definition of expressway into the Act and also amends section 86 to expand the powers of the police and council officers to remove vehicles that have been left unattended on an expressway.

The purpose of this Bill is to make changes to the Road Traffic Act to allow vehicles within classes prescribed by the regulations to make U-turns at prescribed signalised intersections and junctions. It is intended initially to limit this initiative to buses making U-turns at the junction of King William Road and Victoria Drive, Adelaide. However, the legislation is designed so that the same facility can be extended to other intersections and junctions, and other classes of vehicles, prescribed by the Regulations, should the need arise.

RSL MEMORIAL HALL TRUST BILL

 

The purpose of this Bill is to enable the Returned Services League of Australia (SA Branch) Incorporated to sell Memorial Hall and use the proceeds of the sale to buy or lease premises suitable for its present needs. The Services Memorial Hall Act 1939 is repealed and this Bill substitutes the trust under which the RSL holds the Hall and authorises its sale. The proceeds of the sale will be subject to the new trust.

SECOND-HAND DEALERS AND PAWNBROKERS BILL

 

The purpose of this Bill is to build upon the provisions already in place dealing with second-hand goods. The Bill addresses concerns relating to the character of persons involved in the business of dealing in second-hand goods and pawning goods. The Bill extends the information to be kept in records and strengthens the police powers of entry and inspection, to allow the police access to computer information and to require copies of records. The Bill strives to achieve a balance between the needs of those who conduct business and the needs of the law enforcement authorities to have an increased ability to deal with traffic in stolen goods.

SECOND-HAND VEHICLE DEALERS (COMPENSATION FUND) AMENDMENT BILL

 

The purpose of this Bill is to clarify who can make a claim against the Second-hand Vehicles Compensation Fund. The Bill will limit claims against the fund arising from the sale of vehicles by auction in circumstances where the auctioneer sells vehicles on behalf of persons who are not licensed dealers. Where the person on whose behalf the vehicle is auctioned is a licensed dealer then the usual rules relating to claims from the fund will apply, and as at present the purchasers of such vehicles will have rights to warranty.

ST. JOHN (DISCHARGE OF TRUSTS) BILL

 

The purpose of this Bill is to release St. John Ambulance Australia from trusts associated with property held by it and to rationalise properties held between the two organisations, SA St John Ambulance Service Incorporation (the Ambulance Service) and St John Ambulance Australia - South Australia Incorporated (St John).

 

The Bill provides a means of discharging or replacing charitable trusts affecting property held by a St. John association.

STATUTES AMENDMENT (ATTORNEY-GENERAL’S PORTFOLIO) BILL

 

The purpose of this Bill is to make minor amendments to several Acts administered by the Attorney-General.

 

Criminal Law (Sentencing) Act 1988.
The Bill amends section 13 "Order for payment of pecuniary sum not to be made in certain circumstances" to make it clear that where that section applies the court may order the payment of a reduced pecuniary sum.

 

Enforcement of Judgments Act 1991.
The Bill amends section 12 "Enforcement of judgments by proceedings in contempt" to give the sheriff power to enter or break into land when executing a warrant for contempt of court issues under the Act

 

Evidence Act 1929.
The Bill amends section 71a "Restriction on reporting proceedings relating to sexual offences" to make it applicable to summary offences and minor indictable offences that are to be treated as summary offences (because the defendant has not elected for the matter to be heard by a superior court).

 

Fences Act 1975.
The Bill amends section 12 "Powers of court" to provide that, in the case of a fence dividing primary production land from land used for residential or other purposes, an adequate fence is a fence that is adequate for the primary production purposes or a fence that is adequate for the residential purposes, whichever would cost less. The Bill also amends section 16 of the Act to ensure that the contribution payable for repairs to a fence will not exceed the amount that a person would be liable to pay if the fence were completely replaced.

 

Law of Property Act 1936.
The Bill makes a number of amendments to take away the uncertainty that currently exists in relation to the jurisdiction of the District Court and Magistrates Court under this Act. However, the Supreme Court will retain exclusive jurisdiction in respect of class closure, perpetuities and accumulation.

 

Magistrates Act 1983.
The Bill amends section 13 "Remuneration of Magistrates" to remove the reference to the Chief Justice and substitute a reference to the Chief Magistrate.

 

Statutes Amendment and Repeal (Common Expiation Scheme) Act 1996.
The Bill makes minor amendments to the Act to include the Fisheries Act 1982 and Travel Agents Act 1986 to cater for the introduction of the Common Expiation Scheme.

 

Summary Offences Act 1953.
The Bill amends section 15A "Possession of body armour" to allow the Commissioner of Police to give an approval to a person or a class of persons to sell, manufacture, distribute, supply, possess or use body armour.

STATUTES AMENDMENT (COMMUNITY TITLES) BILL

 

The purpose of this Bill is to enable the smooth transition from land division under the Strata Titles Act to land division under the Community Titles Act.

 

The Bill provides for a cut off date for new schemes under the Strata Titles Act where proceedings for the deposit of the strata plan have commenced before a date to be set by proclamation. The date will be set following industry consultation. Proceedings for the deposit of a strata plan will be taken to have commenced either when application for subdivision by strata plan was made, or when application for approval to construct the building to be divided by the plan was made, whichever application was first.

STATUTES AMENDMENT (REFERENCE TO BANKS) BILL

 

The main purpose of this Bill is to remove discrimination against building societies and credit unions from South Australian legislation where it requires moneys to be deposited with, borrowed from or invested with banks. The Bill amends section 4 of the Interpretation Act 1915 to insert a definition of "bank" (which would, unless excluded, apply to all Acts and instruments made under Acts) and to provide for the making of proclamations for the purposes of that definition. The proposed definition would mean that a reference to a bank (or a derivative term) includes a reference to a building society, credit union or other body of a proclaimed class.

The purpose of this Bill is to require that a referendum be held at the same time as the next State election. The referendum question would be - "Do you support the enactment of legislation to regulate and control the practice of voluntary euthanasia subject to stringent safeguards?".

WAITE TRUST (MISCELLANEOUS VARIATIONS) BILL

 

The purpose of this Bill is to make variations to the terms of the Peter Waite Trust. The Bill varies the terms of the Trust (without negating the original trust requirement that the land be used for the purposes of an agricultural high school) to allow the land to also be used for vocational agricultural education and training and other purposes beneficial to agricultural education and training approved by the Governor on the recommendation of the Attorney-General. The Bill also makes it clear that the land may be used for the benefit of persons of either gender.
